METAL DEALER LEGISLATION - UPDATE FROM SCOTTISH GOVERNMENT


The Scottish Government has today advised us that they are “continuing to work on the commencement and implementation of the changes to the Scottish metal dealers regime. Unfortunately it has not been possible to lay a commencement order before Christmas, but it is hoped to be done early in 2016. This will have a knock on impact with the other likely dates for the regime coming into effect, but we would expect to have more clarity on these in early 2016.”

EA TO GET £20 MILLION TO TACKLE WASTE CRIME

Some potential good news for members!

Over the next 5 years the Environment Agency will receive an extra £20 million, from Landfill Tax revenues, to escalate the fight against illegal waste operators.  This is in response to strong criticism from the waste industry, including MVDA, that the EA isn’t adequately funded to fight illegal waste crime.

MVDA has played a key role in this, highlighting the scale of illegal car dismantling & the undermining effects this has upon legitimate business.

Most recently MVDA submitted detailed evidence to DEFRAs review of waste ‘exemptions, about how the U16 ELV exemption is being widely abused.

MVDA is due to complete its review of all 475 U16 exempt operators by Christmas, but preliminary results suggest that a very large proportion of U16 exempt operators are actually illegal vehicle dismantlers.

MVDA members will be updated in January when MVDA has submitted the full report to DEFRA.

IAN HETHERINGTON TO STEP DOWN AS DIRECTOR GENERAL OF THE BRITISH METAL RECYCLING ASSOCIATION (BMRA)

LetsRecycle is reporting that Ian Hetherington is stepping down as DG of BMRA.  Ian has been DG since 2009, & will continue to advise the BMRA on European issues before retiring in September 2016.

During his interview with LetsRecycle Mr Hetherington said that metal theft, & the resulting Operation Tornado & ultimately the Scrap Metal Dealers Act 2013, had taken up a very significant proportion of his time.  He said that in his opinion the blame apportioned to the scrap metal industry for its role in perpetuating metal theft was “wholly wrong and unjust” – a view regarded by many with some scepticism.  He further expressed his concern that the police (& local authorities) have failed to follow up & enforce the Act, resulting in a significant number of operators ignoring the law (& still paying cash) – a view shared by many!

In the run-up to retiring, Mr Hetherington will represent the BMRA on the board of the European Recycling Industries’ Confederation (EuRIC), looking at the impact on the metals recycling sector of new EU legislation delivered through the circular economy package.

The role of DG at BMRA will be taken over by Robert Fell, who already has 30 years’ experience in the metals recycling sector, most recently as a senior research & development manager for packaging specialist Ardagh Group.  He also serves as director of the British Aerosols Manufacturers Association & acting chairman of the Metal Packaging Manufacturing Association.

Alongside the new DG, the BMRA Board has promoted Howard Bluck, the BMRA’s current head of environment to Technical Director.

And it's completely FREE OF CHARGE to all MVDA members.

It's a pretty basic system at the moment, but it can be further developed if it proves useful to/ popular with members.

There are no IT system requirements, other than access to & ability to use later MS XL packages.

If you are a MVDA member, simply log in, download the template, add your vehicle details & upload the file.

WILL THE SCRAP METAL PRICE COLLAPSE RESULT IN MORE ABANDONED VEHICLES?


There is growing speculation that a continuing decline in scrap metal values will witness a resurgence of abandoned vehicles, and a sharp contraction in the ELV & metals recycling industries.  Pessimism in the marketplace has been underlined with the recent major metal industry closures, collapses & cutbacks - including the announcement today by TATA about 1200 UK job losses.

In recent months we have heard reports of members starting to refrain from paying for ELVs needing collection or offering only low prices for ELVs delivered into their sites.  The brunt of the value collapse is being experienced by small volume operators but even larger operators in some parts of the country are seeing collected bulk light iron prices as low as £25/ tonne.

It was back in 1999-2003 that abandoned vehicle problems last reached fever pitch, with a reported 330,000 vehicles being abandoned annually – with local government authorities (i.e. the taxpayer) footing the bill.  At the time, it was the weakness in the UK vehicle registration system that allowed this to happen – something that continues largely unchanged to this day, with up to 600,000 vehicles disappearing in the UK every year.  But this was before the ELV Directive was in place.

So the collapse in metal values potentially moves us into uncharted territories.  The EU ELV Directive, & the ‘own marque’ system implemented in the UK, was supposed to ‘head off’ this problem, by making ‘producers’ (vehicle manufacturers) responsible for ‘zero value’ ELVs and all VMs were required to, & have, established ‘free take back’ networks (the two service providers being CarTakeBack & Autogreen).

It remains to be seen exactly what ‘free take back’ really means, but it is generally envisaged to mean ‘free acceptance upon delivery of the ELV by the owner to an appointed take back location’.  Whether it would be acceptable to make a charge for collection is currently unclear.  But it is also our current understanding that service provider contracted ATFs are legally obliged to accept ELVs delivered to them FOC – a situation many thought would never arise.  Non-contracted ATFs have no such acceptance obligations.

MVDA members are invited to let us know, in confidence, how they are currently coping & what values they are managing to obtain for light iron sold to metal merchants.

We will be in touch regularly with Government to see how they view the current situation.

Having spoken to many of you and/ or having received comments and submissions from you in the past few weeks, we are now in the process of putting together a report summarising the findings of the Cutting Red Tape review into the waste and recycling sector. The report and the review would not have been possible without the contributions we have received so far from you and your members so this comes with a huge thank you for your input.
In order for us to give context to some of the themes and issues that have been raised, we have been working with our analysts to establish a baseline of the costs and impacts to the industry. It would be really helpful if you could circulate the survey below to your members – the survey should only take a few minutes to complete and the closing date is Monday 19 October

The Environment Agency has announced that it is to conduct a ELV ATF campaign and Audit.

The focus of this campaign is on the depollution process and the disposal route for the waste produced. The Audit will asses effectiveness of your depollution process and the storage and handling of the associated fluids and waste materials. The audit will also include; technical competence, record keeping, compliance with hazardous waste regs and F Gas compliance.
