New Drug Driving Law comes into force March 2015

A new offence, to make it easier for the police to arrest drivers who drive after taking illegal drugs or abuse medicinal drugs, will come into force in England and Wales on 2 March 2015.

The new law will make it an offence to drive while over specified limits for a total of 16 drugs. Eight of the drugs could be used for medicinal purposes although the specified limit allows for the normal recommended doses that most patients would be prescribed. Patients who take their medicines as intended should therefore not be affected by this legislation, provided the medicine does not affect their driving.

Insurance Category B vehicles and body shells for sale on E-Bay

The MVDA register of Category B vehicles & body shells reported by members to be on sale on eBay has passed the 350 mark, in less than 6 months.  And these are just examples sent to MVDA by members – so they probably represent just the ‘tip of the iceberg’!

Members will be aware that MVDA has been pressing both Government & the Insurance industry to tighten up regulation surrounding motor salvage.  MVDA took the opportunity presented by the review of VIC to highlight the weakness of the current salvage CoP, especially relating to companies/ organisations that don’t adopt it (like some Police Forces & well known fleet & lease operators) and the handling of category A & B vehicles. But also the widespread ‘commercial’ mis-categorisation of salvage and the ‘disappearance’ of over 1 million category C vehicles.

Work undertaken by MVDA has already highlighted a number of problems, such as the significant amount of unrecorded salvage & the fact that every year thousands of category A & B vehicles are not issued with CODs.  On top of this, there is an active market in the export of category B vehicles, many of which are almost are certainly repaired overseas.  And it would appear that there has been a resurgence in the widespread availability of body shells (sometimes with V5s).

MVDA has called on all CoP stakeholders to support an overhaul of the Salvage CoP, & to provide much more transparency.  This must include ensuring that all organisations that produce salvage adopt the CoP, that categorisation is transparent & that the most contentious salvage - category A & B - is physically destroyed in the UK & can never be repaired .


It is encouraging to see that the insurance industry, via Thatcham, is currently undertaking a review of the Salvage CoP & ETC Guidelines, and we look forward to seeing its output.  But  to be clear, this is the insurance industry reviewing its own interpretation of a ‘voluntary’ agreement, so we should not automatically assume that this will result in any changes for the better.

Consultation on new airbag regulations

In 2015 BIS plans to replace the 2010 Pyrotechnic Articles (Safety) Regulations with an updated version - the 2015 Pyrotechnic Articles (Safety) Regulations. This has implications for vehicle SRS (secondary restraint systems – including airbags).  This is being done because 2 new European Directives need to be implemented in the UK. Among other things this introduces new requirements to improve the traceability of pyrotechnic articles.

The main changes are that there will be new labelling requirements for manufacturers and importers and, along with distributors, they will also have to keep records (for 10 years) of the registration number of articles, who they have sold pyrotechnic articles to and who has supplied them.  They will also have new obligations to take action over unsafe articles that they have put on the market.

Recycled plastic inferior quality? NONSENSE

There is a long held view that vehicle components, in particular those made from recycled plastics, are inferior in quality to those made from premium grade ‘virgin’ plastics. This is an all too common misconception.
Luxus, the UK based plastic recycler, has produced competitively priced high-performance thermoplastic parts based on a recycled plastic for the auto industry for over a decade now.
The performance of recycled grades can in fact be enhanced so that superior components can be manufactured at a competitive cost. So it’s time that designers feel confident that there is no compromise in performance when specifying recycled plastics.
Historically, the automotive industry’s demand for plastic components made from recycled materials has been for non-visual (hidden) surfaces such as ‘under the bonnet’ or ‘behind the dashboard parts’. For higher profile visual (e.g. interior) parts however, it’s not been quite as common as you may think: Luxus is still the only company in Europe that’s able to meet the criteria for class A’ interior surfaces.
It’s never been possible to offer an inferior product to the automotive industry just because it’s ‘green’. Quite rightly, the expectation is that the product is ‘fit for purpose’, whether it made from recycled material or not. That’s why education by consultation at the very earliest stages of product design & development is crucial.; the Luxus technical team engages directly with designers and specifiers to explain the clear environmental and economic benefits of using recycled plastics right at the beginning of the product development process.  
Although price remains a major concern, it is gradually becoming more common to see many ‘prime’ material applications moving to recycled plastics, as they seek both sustainability and cost benefits without compromising quality. But development of sustainable recycled plastic products also has to take into account the security of supply in the current and future volumes of basic recycled raw materials.  
At the same time, demands for higher performance vehicle applications means higher specification recycled grades, more stringent testing and higher values for recycled products.
MVDA comment.  It’s been at least 20 years now that vehicle manufacturers have been looking at recycled plastic grades, and the apparent continued reluctance to specify these materials is very disappointing.  High quality end uses are essential in driving the value chain. Let’s hope the emerging post-shredder technologies can make a significant contribution.  If any of the parties involved in the automotive recycled plastics chain want to let us know how much recycled plastic they use, and in which applications, we’d be happy to update members.

Remove My Car announces 95% target service for its’ members

In a recent press release Remove My Car, the scrap car disposal network, has announced that it is offering its members a ‘Free of charge’ service to reach the 2015 95% recycling target.  Furthermore, RMC says that it has integrated its system with DVLA to allow members to issue Certificates of Destruction in a much more efficient manner than is possible using the DVLA system. At this stage details of the RMC scheme are unknown.
There seems to be an increasing number of organisations able to offer 95% target achievement. We are aware that EMR is making huge investment in their post-shredder technology, which is rumoured to be able to exceed these targets, but to our knowledge this is not yet fully operational or indeed proven.

Our understanding is that only CarTakeBack is currently able to guarantee its members achievement of the 95% target for 2014 & beyond.

It is not possible for ATFs to attain the 95% target without post-shredder evidence, & it is recommended that all members make clear their requirement for ‘evidence’ when selling their vehicle shells.

However, members are reminded that the 95% target applies to vehicles processed from 1st January 2015.  But the next BIS reporting requirement, due 30th June 2015, is for vehicles processed during 2014 and will still be at the 85% level.

Illegal car breaker receives jail sentence and fine

The owner of a car breaking business in Godstone (Surrey) has been sentenced to serve 10 months in prison, suspended for two years, and ordered to pay £34800 after pleading guilty at Guildford Crown Court to an illegal waste activity.
William Creasey, of South Godstone, was charged with operating a waste facility without the correct environmental permits in a manner likely to cause pollution after numerous complaints from members of the public and an investigation by the Environment Agency brought to light issues at the Surrey site, including fires burning in skips and oil escaping to nearby watercourses.
The local authority said that its officers have been working with Creasey since “a flurry of complaints” from the local community prompted a visit to the site in 2010. Subsequent investigations revealed the site being used to illegally burn waste scaffolding boards, store waste tyres and wheels, damaged vehicles, and skips full of waste metal.
Throughout the investigation the EA said it worked with Creasey to make him aware of his responsibilities, with little apparent affect, and between 19 March 2010 and 23 January 2013, 46 reports of illegal activity at the site were received.
Environment officers visited the site on 23 January 2013 with officers from Surrey Police and served Creasey with a court warrant.
A search carried out on that day found nine skips filled with broken car parts, car wheels, and vehicle parts strewn across the yard; there was an oily sheen covering many parts of the yard with a stream along the boundary also black and oily and rusty skip containing burnt remains.
MVDA comment: While its good to see illegal operators getting their ‘due deserts’ this case once again highlights the lacklustre performance of the Environment Agency and local enforcement authorities. It took 3 years & almost 50 separate complaints before decisive action was taken.

MVDA member SS Components win prestigious Green Apple award

Mirfield, West Yorkshire, based SS Components Ltd has won a ‘GOLD CATEGORY’ Green Apple Environment Award in the national campaign to find Britain’s greenest companies, councils and communities.

They competed against more than 500 other entrants in the Green Apple Awards for Environmental Best Practice, and were presented with their trophy and certificate at a glittering presentation ceremony in The Houses of Parliament, on November 10th 2014.

The Green Apple Awards, which began in 1994, have become established as a major recognition for environmental endeavour among companies, councils, communities and countries.  In the UK, they are supported, amongst others, by the Environment Agency, Chartered Institute of Environmental Health, Chartered Institution for Wastes Management.

SS Components started, by Mr. John Smith in 1974, as a vehicle dismantler, but later changed direction.  Today, the company has 2 main services:

NEW PARTS LOCATION SERVICE TO BE LAUNCHED BY MVDA IN 2015

MVDA is currently in the preliminary stages of developing a new web-based ‘used parts’ location service.  It will be ‘free of charge’ to customers looking for spare parts.

A range of options is currently being considered, but members are invited to tell us whether they think this is of benefit them & what they would like to see (within reason!), bearing in mind that this will initially be developed on a limited budget (so it will be unrealistic to expect ‘part number’ functionality, at least initially).

It is also important that this facility is of use to the largest possible number of members, and so must cater for the variety of ways in which members sell parts.  It must also be low cost.

It is anticipated that VRN look-up will form an integral tool, to ensure that both customers and members have as accurate information as possible about the parts being sought.

Clearly only MVDA members will be able to participate & receive parts requests.

This ‘not for profit’ MVDA system, intended solely to support the activities of the MVDA and the business of its members, forms part of the on-going drive to improve services for member companies.

For the industry, by the industry!

FOR SALE - LEFORT CAR BALER-CRUSHER, 2003 MODEL, REFURBISHED

Following a recent upgrade, Charles Trent Ltd is selling one of their car balers-crushers.  It’s a 2003-model Lefort Baler A5000 car baler-crusher. The machine can be worked from the cab or by remote.

In the last three years £75,000 has been spent on the machine including a new floor. It has been regularly maintained by Lefort throughout its whole life. 
The hours clock does not work but its operating hours is estimate to be circa 21,000 (approx. 1900 hrs pa).  The asking price is £110,000 plus VAT.

ARA Annual Convention 2015

Next year the Automotive Recyclers Association (ARA) will hold its 72nd Annual Convention in Charlotte (North Carolina) on Oct 7-10th 2015.

Terry Charlton is thinking of arranging a road trip for the convention, which will include visits to dismantling/ salvage yards and some sightseeing.  The convention itself includes a large trade show, educational seminars, and social functions.  Tickets will also be available for the Nascar Sprint Cup at Charlotte International Raceway.

The annual ARA Convention is often attended by UK vehicle dismantlers/ salvage agents (such as Charltons, Hills, Silverlake & ASM).

Delivering Untaxed Vehicles to an ATF

Following on from the recent changes in vehicle taxation, a number of members have asked whether there is a ‘concession’ for delivery of vehicles to an ATF for disposal.  The DVLA has responded with the folowing:

“All vehicle registration and licensing is governed by the Vehicle Excise and Registration Act 1994 (as amended).  The Act requires all mechanically propelled vehicles that are used or kept on the public road to be correctly licensed.  If the vehicle is being kept off the public road, it must be subject to a Statutory Off Road Notification (SORN).

Any vehicle which has any wheels in contact with the public road is in breach of legislative requirements if it is not currently licensed. 

The only way in which an unlicensed vehicle can be taken to an ATF is if it is transported. 

The MOT concession is stipulated in law, but there is no such law to use an unlicensed vehicle on the public road to take it to an ATF”.

We hope that this clarifies the situation for all involved in the processing of End of Life Vehicles.

Issues with Scrap Metal Dealer public registers

During the course of our work on the ‘expiry reminder’ service for members it has come to our attention that there are many problems with the Environment Agency-maintained ‘scrap metal dealer’ public register.

It would appear that many of our members are NOT present on the public register, giving the clear impression (to potential customers, Police, insurers and any other interested party) that they are acting illegally.

For the sake of clarity, all vehicle dismantlers, salvage agents and scrap yards must be registered.

It is therefore essential that every member checks the public register, and any missing or incorrect details are notified to MVDA as soon as possible, giving us the licence number, local authority responsible & the name on the licence. We will take up the matter for you with the EA to get it rectified as a matter of urgency.

MVDA Launches New Free Licence Reminder Service

MVDA will shortly be launching a new FREE licence ‘reminder’ service for members.  

With the working day being so hectic it is very easy to overlook this type of thing, and an expired licence often only becomes apparent when you need it (for example when the waste oil or battery collector arrives on site!).  

This new system will automatically e-mail members an ‘expiry reminder’ 1-month, & then again 1 week, before their licence expires.  Initially it will apply to the following licences:
  • Hazardous Waste registration (Premises Code)
  • Waste Carriers Licence
  • Scrap Metal Dealer registration
This forms part of the drive to improve services for member companies, and is likely to be the first of several such developments in coming months.  But if there are other services you would like MVDA to develop then please let us know.

Find-A-Part Changes Hands


FIND-A-PART, the UK’s original ‘used car parts’ finding system has recently changed hands, and has been rebranded and relaunched.  The identity of the purchaser has not as yet been disclosed. But there is a new management team & the ‘relaunch’ is being overseen by Paul Fox, who is both a MVDA Committee Member & currently Chairman of EGARA (the European dismantlers’ Association).

The new FAP now offers the following to customers looking for parts:

§   No premium rate phone numbers
§   No premium rate text messages
§   Simple free text parts input without complicated or confusing drop down  boxes
§   Ability to see who the parts seller is without premium rate numbers
§   No hidden costs whatsoever
§   Quality guaranteed parts
§   No inflation of parts prices - the price quoted is the price the customer pays

Analyses of requests show that 82% of customers are using Find a Part return on a regular basis, demonstrating its worth to customers. 

Following the recent changes, FAP say, there has been an increase in parts requests to such an extent that the number of parts suppliers needs to be increased to keep pace with demand.

For a limited time, FAP is offering a 3-month ½-price trial, and a discount for MVDA members.
Membership rates vary depending upon the number of makes/models/part types etc. for which a member wishes to receive requests.

MOTOR TRADERS TO NOTIFY DVLA WHEN A PRIVATE MOTORIST SELLS THEIR VEHICLE INTO THE MOTOR TRADE

DVLA this week launched a small pilot exercise of its latest digital service. While its been possible to tax a vehicle online for over 10 years, the process of telling DVLA of changes to the owner/ keeper has remained purely paper based.  

The new service will allow motor dealers to inform DVLA that a vehicle has been sold into the motor trade. 
Currently, if you sell a vehicle you have to tear off a slip of paper (notification of sale – V5C/3) from the V5C registration certificate (logbook) & send by post to DVLA. Some time later you’ll hopefully receive notification from DVLA acknowledging that you’re no longer the keeper of the vehicle (and no longer liable for tax, speeding fines etc.!).

Under the new online service, when a vehicle is sold into the motor trade the dealer will be able to tell DVLA that they’ve purchased the vehicle. This will update DVLA records the same day. This means that the previous owner will be eligible for a refund of vehicle tax, if any is remaining, and is no loger be registered as the keeper of the vehicle. There will no longer be a need to send the tear off slip from the V5C by post to DVLA. The previous owner will still receive a notification in the post from DVLA confirming they’re no longer the keeper of the vehicle and the vehicle record has been updated.

To date, the response from participants of the test system has been overwhelmingly positive, with most saying they are willing to undertake the service on behalf of the customer.  Some traders have even said they’ll set up self serve points to allow the vehicle keeper to notify DVLA themselves, providing assistance and support where needed.

This initial test system is limited to just 15 traders, ranging from the very small independent dealer selling 10-15 cars a month, to dealers processing 20,000 or more. It also encompasses different types of users, from auction houses to specialists in truck and bus sales. This small but diverse pilot group will provide valuable real life insight before the launch of the full system later this year.

Presumably, it will be up to the motor dealer to decide whether or not they want to use this system, meaning that many dealers who operate on a cash basis will continue to avoid their legal obligations.

Unfortunately, DVLA will not record the details of the motor trader the vehicle is sold to, nor will there be any requirement for motor traders to inform DVLA if they sell the vehicle to another motor trader.  One would have thought this was the next logical extension of the system – but apparently not.  So this still won’t address the problem of the 600,000+ vehicles that disappear every year into the motor trade & never reappear!

It is also currently not clear whether DVLA has any plans to extend the system to vehicles sold to overseas buyers (i.e. exported).

Static Car Baler For Sale

MVDA member London Autoparts (Wembley) now has for sale a Lefort P514T static car baler-crusher, 2008 model.  

It’s been fully refurbished & looks ‘as new’.

This is the top spec model with a Caterpillar diesel engine, fitted cab (which is immaculate condition inside) & also has the wireless remote control option.

It’s been very well cared for and 100% reliable.  It’s only been used for car body shell crushing and baling, although it can be used for other types of recycling business.  This  one is capable of crushing  30 cars per hour !!


It’s already been replaced with a brand new machine so is available immediately!!

It’s competitively prices at just £100,000 and is available for viewing & demonstration (by appointment) on site in Wembley (Middlesex) 6 days a week.

DVLA on-Line Services - Further Welcome Developments

DVLA has just issued further (very brief) information about two new on-line services it is currently developing and has been testing with the vehicle fleet industry:

§        View Vehicle Record (VVR)
§        Disposal to Trade (DTT)

VVR will allow a fleet operator to be able to view, on-line & in real time, the details of all the vehicles registered to them. 

DTT will allow a company to notify DVLA that a vehicle has been sold to a motor trader & this will remove the vehicle from their records (so it won’t subsequently appear on their VVR).

With some large fleet operators owning more than ½ million vehicles, and notifying DVLA of 500-1200 notifications of disposal to a motor trader every day, both these developments have enormous time-saving potential.

It’s great to see DVLA making these changes & embracing technology to make everyone’s life easier.  And hopefully, this will eventually allow DVLA to track vehicle movements all the way through the motor trade, and ultimately clamp down on illegal dismantling and can keep track of vehicle exports.

DVLA On-Line Service - View Driving Licence - Now Live

DVLA has now launched its on-line service ‘View Your Driving Licence’              

This allows you to view the information about your driving licence held by DVLA, including when it expires, which categories of vehicles your are permitted to drive (& any restrictions), and any ‘endorsements’ currently on it.

Naturally, you can only view your own license.

You will need the following information.  Your:
  • NI number
  • Driving licence number

MVDA MEMBER RECYCLING LIVES OPENS NEW CAR FRAGMENTIZER

Long-term MVDA member Recycling Lives has recently installed a state-of-the-art car & metal shredding facility at its 15-acre site in Preston, Lancashire.  Located very close to M6 J31a, the 2500hp shredder only became operational this summer.

GUIDANCE ON THE EXPORT OF USED PARTS.

Over recent weeks there have been a number of enquiries to the MVDA office about the export of used parts.  This blog contains information on consignments of vehicle parts for reuse provided by the Environment Agency.
Some companies sell parts ‘ex-works’ to companies/ individuals that carry out the export, whereas others actually carry out the export themselves.  The following information will prove useful in both cases.

This note outlines the steps ATFs can take to ensure that working vehicle parts intended for ‘reuse’ overseas for their ‘original purpose’ can be clearly distinguished from waste that requires greater control. The EA is unlikely to view shipments of reusable parts as waste where these parts have been competently assessed as working and they are satisfied they are intended for reuse for their original intended purpose. Other competent authorities overseas may take a different view and may insist on such parts being notified as waste or may prohibit their import altogether.

It should be borne in mind that in the event that any shipment of fluid containing parts (e.g. engines, gearboxes) that are judged to be waste, by either the EA or overseas regulators, will be classified as hazardous waste, with the concurrent significant repatriation charges.  For this reason it is recommended that these procedures are followed.

Preparing parts for reuse
The EA developed the following procedures in partnership with experienced UK operators. They are not compulsory but are considered a helpful and practical means of fostering a common understanding between ATFs and regulators both here and overseas for exporting parts for reuse.

Assessment
All parts intended for reuse should be assessed by the operator to ensure that they are suitable for re-use without modification or repair.
Engines should be assessed as suitable for re-use prior to depollution of the ELV and removal of the engine. Engines should be drained of oil and bunged prior to export, retaining no more oil than necessary to prevent corrosion during storage and transit. Engines that leak oil in transit are a pollution risk and carry a significant risk of being detained or repatriated at the cost of the operator.
Other fluid containing components (e.g. gearboxes) should also be drained of fluids if a drain point is available & drainage does not damage the unit.  Once drained, any holes should be plugged to prevent leakage of oils.  ‘Sealed for life’ units (e.g. shock absorbers) do not need to be drained. 
Tyres intended for reuse should be assessed as suitable for re-use as per the UK part-worn tyre regulations (having regard to tread wear, side wall damage etc.). Tyres that would not be road legal in the UK are regarded as waste regardless of the whether or not they would be road legal in the destination country.

Information about the parts
To support the claim that the parts are intended for reuse without further treatment, the following information should accompany each consignment of parts:

  •                     Engine size (cc)
  •                     Engine number (where applicable/ possible)
  •                     Fuel type
  •                     Unit value
Other parts
  •                     Item description (e.g. door panel, wing mirror, rear light etc.).
  •                     Quantity of item (e.g. Doors x6, rear lights x12 etc.)
  •                     Unit value
Other information to accompany the consignment
Statement that:  “All items listed originate from de-registered UK vehicles and are sold as working used parts for reuse only”.

Details of the seller, including:
  •                     Full company name
  •                     Full company address
  •                     VAT number
  •                     ELV ATF permit number
  •                     Telephone number
  •                     Fax and email details if available
  •                     Contact name
Details of the purchaser, including:
  •                     Full company name
  •                     Full company address
  •                     Telephone number
  •                     Fax and email details if available
  •                     Contact name
  •                     Regulation Authority reference if applicable
Seller’s company stamp signed over by the company’s authorised person and dated.

Paperwork to include
  •                     Total number of containers in consignment
  •                     Shipping container seal number if applicable
