VEHICLE DISMANTLERS COMING UNDER SCRUTINY FOR HEALTH & SAFETY?

Earlier this year we were contacted by the HSE with a general query about H&S at vehicle dismantling yards. They said that they had identified these premises as a potential area for attention in 2016 & 2017. They did not disclose the reasons for this.

 

Separately we were also contacted by Environmental Health departments at a number of local Councils with queries about dismantling yards. These seem to be general... queries, because they don’t understand how the industry works or what is ‘best practice’ & so didn’t want to go onto site unprepared. This is similar to what we saw in 2014-5 with local authority & Police enforcing SMDA13.

 

As you know there has been a lot of attention about fires at waste sites. This may partly be the cause of these enquiries, but they appear to be unrelated to SMDA13.

 

We passed on to the councils the contact details for Phil Wass, as an independent H&S consultant with experience in this industry.

 

On Monday 21st March, MVDA attended as an observer a training session for Environmental Health Officers organised by Phil.

 

Phil gave a good presentation about how the industry works & what to expect. He ran through vehicle recovery, storage, depollution, crushing, FLTs, scrap handlers, vehicle movements, manual handling, TCM etc.

 

Sadly, council EHO attendees appeared not to have been liaising with their colleagues & Police responsible for enforcing SMDA13 or with the local EA.

 

MVDA members are advised that the HSE & local councils appear to be showing an increasing amount of interest in our industry & to make sure they’re prepared. We will let you know if we hear of anything in particular.

SCRAP METAL FIRM IN COURT OVER SEVERE INJURIES TO WORKER DUE TO FORKLIFT TRUCK MISUSE

The Health & Safety Executive, HSE (www.hse.gov.uk) reports that a scrap metal firm and its director have been sentenced after a Manchester worker suffered severe injuries to his left arm when it became stuck in a forklift truck.

The worker, aged 30, from Levenshulme remained trapped for over two hours while the emergency services tried to free his arm from the vehicle’s mast at Levenshulme Trading Estate, Printworks Lane on 8 November 2013.

Ultimate Traders Ltd and company director Nasir Rashid were prosecuted by the HSE after it emerged he had been told to stand on the forks of the truck to help move scrap cars into the back of a shipping container.

Manchester Crown Court heard that Mr Rashid, aged 36 from Greenford in London, had been driving the forklift truck and that the scrap cars were due to be exported to Pakistan where the metal would be sold.

The worker suffered severe crush injuries when his arm became trapped and it took the combined effort of three fire crews, a specialist major rescue unit, two air ambulances, a medical team from Manchester Royal Infirmary and three ambulance crews to rescue him.

 

He sustained nerve damage to his left arm which makes it difficult for him to grip or lift items, and was in hospital for nearly two months. He still needs to visit Manchester Royal Infirmary for treatment and has been unable to return to work due to the extent of his injuries. The court was told the company failed to report the incident to HSE for nearly three months, despite being told on several occasions that this was a legal requirement.

Speaking after the hearing, HSE Inspector Sarah Taylor said: “The worker remained trapped for over two hours while the emergency services battled to cut him free, but this incident could easily have been avoided.

“Ultimate Traders and Nasir Rashid had a legal responsibility to make sure the worker stayed safe, but instead he was instructed to climb onto the forks of a forklift truck to move scrap cars into a container. He suffered severe injuries as a result which will affect him for the rest of his life.

“Workers should never be allowed to stand directly on the forks on a forklift truck because of the risk of them falling or being injured by moving parts on the mast. This case should act as a warning to firms that they will find themselves in court if they do not take the safety of workers seriously.”

FIREFIGHTERS TACKLE MAJOR BLAZE AT STOKE CAR BREAKER.

On 6th March the Stoke Sentinel reported that 22 firefighters had worked overnight to extinguish a major blaze at the car dismantler McGuinness & Sons, in Longport, Stoke-On-Trent.

Emergency services had been called to the scene at around 5.40pm, where they found a number of vehicles alight and plumes of black smoke rising in the sky.

The blaze is believed to have been started deliberately.

Staffordshire Police ha...ve also been made aware of a possible connection between this fire & a second incident, which took place less than 20 minutes later in a disused factory behind the scrapyard, in Mill Vale Street.

A Staffordshire Fire and Rescue Service spokesman said: "A number of cars have been on fire and compressed air foam is now being used as water was ineffective. The metal was so hot, the water was just evaporating. The foam is now smothering it and the incident is under control.”

"We were also called out to another incident in the area at 6pm, when we received a call regarding a fire in a disused factory in Milvale Street. The police are aware of the incident."

ALL MVDA CONCERNS RECOGNIZED IN GOVERNMENT REPORT ON CUTTING RED TAPE IN THE WASTE INDUSTRY!

As part of the Cutting Red Tape programme, Government ran a review between July-September 2015 to identify barriers to growth & productivity in the waste sector.

The review received evidence from over 100 companies & Trade Associations (including MVDA).

The report from the Cutting Red Tape review of the waste sector has now been published.  It details the main issues raised by industry & the Government’s response. It can be found here

All of the issues raised by MVDA have been acknowledged in the report, including problems with permitting, exemptions, EA inspections, OPRA, TCM/Continuing Competence, & of course illegal operators.

This clearly demonstrates the value of your Trade Association membership.
The review identified numerous issues with waste regulation, including:

• Definition of waste: decisions on whether or not materials are waste or have ceased to be waste are burdensome, costly & time consuming.

• Permitting: the length of time taken to process permit applications, inconsistency between officials & the use and application of ‘standard rules’

• Exemptions: the requirement for registering exemptions for low-risk activities creates unnecessary burdens compared to the levels of risk.

• Inspections: some inspections are being undertaken by officials without the necessary qualifications, experience or training to properly or accurately carry out an assessment. There is also a perceived lack of a risk-based approach to compliance visits and inspections.

In response the Government has said:

• Definition of waste: we will amend guidance to revise & clarify the definition of ‘waste’ & ‘by-products’; the first stage will be completed by March 2016 with the second stage completed by March 2017.

• Permitting: we will start publishing revised guidance for the Environmental Permitting Regime from March 2016, working with business across the sector to investigate the issues & identify root causes of concerns by April 2016, & put an action plan in place to address issues raised in the review by August 2016.

• Exemptions: we will complete an assessment of compliance with exemptions by the end of March 2016 which will inform any subsequent proposal to review existing exemptions; & work to review & streamline the online registration system & deliver initial improvements by June 2016.

• Inspections: we will implement a programme to introduce professional environmental regulator status for staff to ensure inspectors have a broader understanding & knowledge of the challenges facing the sector by March 2016 & engage with businesses on reviewing how the Operational Risk Appraisal system could be improved & further deliver benefits of the ‘earned recognition’ principle by June 2016.

Environmentally Sound Solution to Unwanted Oil Reduces Disposal Costs

 

The Oily Issue

Auto Spares and Salvage, like many auto-dismantlers, operates in a rural/farmland area. There are strict EA laws in place that require them to be responsible for any pollutants they might produce. Failure to comply with these laws can result in hefty fines for the companies

When it comes to oil, the main goal for auto-dismantlers is to keep the oil from reaching any natural water source. To do this, site operators must keep the pits or interceptors clean. Should the interceptors become too full, there is the chance that the oil or hydrocarbons can contaminate surface or ground water. It’s also crucial to keep the interceptors clean in case there is a flood - heavy rainwater can cause the interceptors to run over flow.

The Costly and Dreaded Job

Emptying interceptors is a job that can be messy, time consuming, and labour intensive. Additionally, it can also be very expensive. Phil Wood, Auto Spares and Salvage’s Yard Manager, is responsible for waste management and implementing environmental policies. Wood explained to Abanaki UK salesman Graham Smith that Auto Spares and Salvage would empty the interceptor with a capacity of 6,000 gallons 3 times a year at a cost of over £2000. Wood added that Auto Spares and Salvage is always striving to “set an example to others”. With that thought in mind, Wood set out to find a solution that would make cleaning the interceptors easy and efficient for site operators, would reduce removal costs, and was an environmentally sound solution.

A Green Solution

After learning about Abanaki Oil Skimmers Wood & arranging a site visit, Abanaki’s Graham Smith visited the site & recommended Abanaki’s PetroXtractor oil skimmer.

The PetroXtractor is a dependable and cost-effective solution to unwanted oil in water where access to the fluid surface is limited. Why Choose an Oil Skimmer?

Oil skimming makes use of the differences in specific gravity and surface tension between oil & water. How the Savings Stacked Up

Typically the PetroXtractor’s 12v DC battery is run on solar power, or can use 12V vehicle batteries.  The skimmed oil is collected into mobile containers, which can then be transferred to a larger waste oil tank.

Wood explains that some of the key benefits in utilizing the PetroXtractor are that it is simple to use & so easy to train someone on how to operate the skimmer.  It has made drastic improvements at keeping costs down. Initially the interceptor was cleaned several times a year with costs over £2000. Since implementing the oil skimmer the interceptor is now emptied once a year at the cost of only £900. Wood says, “It’s one of the best investments made by the company and has proved to be successful over a number of years”.

SCRAPYARD BOSS GIVEN SUSPENDED PRISON SENTENCE

Wiltshire scrapyard and recycling company owner receives a prison sentence for running an illegal waste site in Melksham.

The owner of a Wiltshire scrapyard and recycling company has received an 18 month prison sentence suspended for two years for running an illegal waste operation from a site in Melksham. The case was brought by the Environment Agency.

Lee Hazel, owner and director of Melksham Metals Recycling Ltd, was sentenced yesterday at Swindon Crown Court following two earlier court hearings in June 2014 and November 2015.

On August 23, 2011 an enforcement officer from Wiltshire Council visited the Lowbourne area of Melksham to investigate a report of illegal waste tipping. He found piles of chalky stone, tarmac road planings & concrete pipes on land at Queenfield Farm beside the old Wiltshire to Berkshire Canal.

The officer reported the incident to the Environment Agency. At the entrance to Queenfield Farm he noticed a trail of ‘chalky liquid’ in the road similar in colour to the waste stone he had seen tipped at the farm. He followed the trail back into Melksham to a road leading to Melksham Metal Recycling.

On September 6, 2011 Environment Agency officers visited Queenfield Farm where they saw a Melksham Metals lorry loaded with stone waste drive onto the site.

In addition to stone waste tipped at the site, waste transfer ‘fines’ were also seen. These fines are small particles of waste resulting from a screening process.

Following the visit, the Environment Agency wrote to Lee Hazel at Melksham Metals asking him to provide copies of waste transfer notes for the previous two years.

Lee Hazel claimed the lorry seen at Queenfield Farm on September 6 was taking stone waste to a permitted site near Chippenham. This contradicted what his driver had told Agency officers. Mr Hazel claimed he had never tipped waste at the farm.

Further inquiries revealed that Melksham Metals had a contract to remove waste stone from a local stone masons yard for disposal at a licensed site. When an Agency officer visited the yard he saw cut pieces of stone identical to the stone waste he’d seen at Queenfield Farm.

A court heard Melksham Metals was paid nearly £178,000 to remove waste from the stone masons yard between November 2004 and May 2012.

The Environment Agency had warned Lee Hazel on several occasions about unlawful waste activities including the illegal disposal of waste at Queenfield Farm & depositing waste on land without an environmental permit & the requirements of duty of care.

Lee Hazel had been involved in the waste industry for 20 years & held a Certificate of Technical Competence (CoTC) by the Waste Management Industry Training & Advisory Board (WAMITAB).

‘It is important waste materials are stored, handled and disposed of correctly to protect the environment & safeguard human health. The defendant in this case continued to operate outside the law despite being put on notice that what he was doing was illegal & ran the risk of prosecution,’ said an Environment Agency spokesman.

In June 2014 Lee Hazel was found guilty of four charges in relation to the dumping of waste on land at Queenfield Farm, Melksham. In November 2015 Lee Hazel pleaded guilty to a further five charges in relation to unauthorised waste activities at his Station Yard premises.

Melksham Metals Recycling Ltd was also convicted of similar offences, but will not be sentenced until after a confiscation hearing in June 2016. This hearing will decide the financial benefit obtained by Lee Hazel & make a confiscation order in relation to that benefit.

Fines & costs against both Lee Hazel & his company will also be decided at that hearing.

100 ABANDONED VEHICLES DISCOVERED IN WELSH SLATE MINE

Up to 100 abandoned cars have been discovered 200 feet underground in a closed slate in Ceredigion, Wales, the Daily Mail has reported.

The cars are thought to date from the 1970s.  The mine is thought to have been working from 1836 & closed in 1960.

HUNDREDS OF FAKE HONDA AIRBAGS SOLD ON EBAY

Police have launched an investigation after Honda Motor Europe alerted them to counterfeit airbags being sold at half manufacturers' prices.

 

Hundreds of motorists are being warned their cars have potentially counterfeit airbags following the arrest of a suspect accused of selling fake equipment on eBay.

 

The man was arrested in Dorset on Thursday as officers told 680 people to urgently return their vehicles to a dealer to have their vehicles checked after buying his stock online.

 

Superintendent Maria Woodall, City of London Police said: "We are urging anyone who has concerns about a possible counterfeit car part they may have to contact their nearest authorised car dealer."

 

Officers launched an investigation after Honda Motor Europe discovered counterfeit airbags were being sold at half their normal prices. Factory analysis showed "they would not deploy as a genuine airbag would on collision, presenting a clear danger to the public".

 

City of London police said. "Every individual has been advised to make contact with their local dealership immediately so that their vehicle receives the necessary checks to ensure it is safe," a statement added.

 

It is understood that 148 of the consumers affected purchased suspected counterfeit Honda CRV and Accord airbags.

 

A 34-year-old man was arrested in Blandford Forum on Thursday morning on suspicion of counterfeiting and money laundering offences. He remained in police custody as officers seized approximately 100 suspected counterfeit airbags, financial documents and computers.  Staff from the Ministry of Defence were also at the address as a precaution due to the presence of explosives in the airbags.

 

As a result of investigations, 680 people were identified by officers from payment records relating to eBay vendors using the names ‘EUTrading’, ‘OMNADRENIAK1984’ and ‘barbo2007.’ It has been established that purchases have been made by a wide range of small and medium-sized businesses and individuals. Officers are currently establishing if the remaining 532 purchases concern other counterfeit manufacturer car parts.

 

The counterfeit Honda airbags had been on sale since September 2013 for approximately £170. Philip Crossman, managing director of Honda Motor Europe’s UK subsidiary, said: “The safety of customers is of paramount importance, and we aim to eliminate counterfeiting. We strongly recommend any modification to the airbag systems of our cars be undertaken by a trained technician in an official dealership. If customers are concerned, they should visit their local dealership.”

ILLEGAL CAR BREAKERS - 37 REPORTED IN THE FIRST WEEK

In the first week of launching our new 'report an illegal car breaker' feature on the MVDA website we have received 37 reports on 36 illegal car breakers.

In 2 of these cases, the operators had recently been permitted.

 

The others we have now reported.

ILLEGAL CAR BREAKERS - 13 REPORTED IN JUST A FEW DAYS

It's been just a few days since we launched the 'report an illegal car breaker' function on the MVDA website & already we have received 13 reports.
 

We've checked them all, & surprisingly none seemed to have an Environmental Permit.  Only 1 appeared to be a registered Scrap Metal Dealer.
 

All have now been reported to CrimeStoppers.  These are then automatically fed through to the national waste crime team.
 

We will report in bulk to the Environment Agency once a month.
 

So a big THANK YOU  to everybody that has submitted information (although it may not be members that have reported them).
